Kids2Camp Organization Terms of Service

These Organization Terms of Service ("Agreement") govern the use of the Kids2Camp platform by businesses, camps, schools, nonprofits, and other organizations ("Organization," "you," or "your") that submit, advertise, promote, or manage camp listings, activities, programs, or services through Kids2Camp ("Platform," "we," "our," or "us"). By creating an account, submitting a listing, purchasing advertising services, or using the Platform, you agree to be bound by these Terms.

1. Purpose of the Platform

Kids2Camp is a discovery, listing, and advertising platform that helps families find camps, activities, and child-related programs offered by independent organizations.

Kids2Camp is not a camp operator, childcare provider, licensing authority, educational institution, employer, transportation provider, or supervisory entity.

Listing approval does not constitute endorsement, certification, recommendation, legal compliance verification, or operational approval.

2. Organization Eligibility

You represent and warrant that:

  • You are authorized to act on behalf of the Organization
  • Your Organization is legally permitted to operate its programs
  • You maintain all required licenses, permits, registrations, insurance, and approvals required by law
  • You have authority to submit payment and enter binding agreements
  • All information submitted is truthful, accurate, and current

Providing false or misleading information may result in immediate suspension or permanent removal.

3. Paid Listings and Advertising Services

Organizations may pay for camp/event listings, featured placement, priority visibility, seasonal promotions, sponsored placements, and future premium advertising services offered by Kids2Camp.

Payment grants advertising visibility only and does not guarantee enrollment, leads, registrations, revenue, ranking position permanence, parent engagement, or conversion performance. Kids2Camp does not guarantee business results from any paid service.

4. Fees and Payment Terms

All fees are charged in U.S. Dollars unless otherwise stated. Fees may include per-listing fees, monthly subscription plans, featured listing upgrades, promotional campaign fees, and seasonal package pricing.

All payments are due at the time of purchase unless otherwise agreed in writing. Payments are processed through third-party payment processors such as Stripe. By submitting payment, you also agree to the processor's terms and policies.

Failure to pay may result in listing suspension, removal from search visibility, account restrictions, loss of premium placement, or collections actions where legally permitted.

5. Refund Policy

Unless otherwise stated in writing: listing fees are non-refundable once a listing is submitted for review; featured placement fees are non-refundable once promotion begins; subscription fees are non-refundable for the active billing period; administrative review fees are non-refundable.

Refund exceptions may be granted solely at Kids2Camp's discretion. Camp cancellations, low enrollment, business performance issues, or dissatisfaction with registration volume do not create refund obligations.

6. Organization Responsibilities

You are solely responsible for program operations, staff hiring and supervision, safety procedures, transportation arrangements, background checks, licensing compliance, insurance coverage, refund policies, parent communications, emergency procedures, and legal compliance in your jurisdiction. Kids2Camp does not supervise or verify operational compliance.

7. Listing Content Standards

You may not submit content that is false, deceptive, or misleading; fraudulent or unlawful; infringing on intellectual property rights; offensive, abusive, discriminatory, or harmful; unsafe for children or families; or misrepresentative of pricing, availability, or qualifications.

We reserve the right to edit, reject, suspend, or remove listings at our sole discretion.

8. Reviews, Metrics, and Reporting

Kids2Camp may provide dashboards, impressions, click tracking, inquiry counts, performance metrics, or reporting tools. These metrics are estimates and informational only. We do not guarantee accuracy of third-party attribution, conversion tracking completeness, lead quality, or registration outcomes. Reported engagement metrics do not constitute guaranteed sales performance.

9. Intellectual Property

You retain ownership of your submitted logos, photos, descriptions, and branding. By submitting content, you grant Kids2Camp a non-exclusive, worldwide, royalty-free license to use, display, promote, distribute, and market that content in connection with the Platform and related advertising efforts. You confirm you have the legal right to provide all submitted materials.

10. Indemnification

You agree to defend, indemnify, and hold harmless Kids2Camp, its owners, affiliates, contractors, employees, and representatives from any claims, liabilities, damages, lawsuits, investigations, losses, fines, penalties, or expenses arising from your operations or services, participant injuries or disputes, refund disputes, misrepresentations in listings, licensing violations, employment disputes, child safety claims, insurance failures, regulatory violations, or violations of these Terms.

This obligation survives account termination.

11. Limitation of Liability

To the maximum extent permitted by law, Kids2Camp shall not be liable for lost profits, lost registrations, business interruption, reputation damage, indirect or consequential damages, parent disputes, camp cancellations, provider misconduct claims, or third-party payment processor failures.

Our total liability shall not exceed the total fees paid by the Organization to Kids2Camp in the twelve (12) months preceding the claim.

12. Account Suspension and Termination

We may suspend, restrict, or terminate your account at any time for nonpayment, fraud concerns, safety concerns, repeated complaints, policy violations, legal risk concerns, reputational concerns, or regulatory investigations. Termination does not eliminate outstanding payment obligations.

13. Modifications to Services

We may modify pricing, listing structures, features, visibility rules, or platform functionality at any time. Continued use of the Platform after changes constitutes acceptance of updated terms.

14. Governing Law

This Agreement shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the appropriate courts located in Collin County, Texas, unless otherwise required by law.
